We organize suppliers’ pools, in coordination with credit insurers and insolvency administrators. The Suppliers’ pool strengthens the suppliers’ position towards the insolvency administrator and facilitates the assertion of retention of title rights and claims.
Our team has long-term experience in insolvency law, enabling us to examine the content and scope of the suppliers’ rights to separate satisfaction due to the simple, extended or prolonged retention of title rights and to defend the suppliers’ interest towards the insolvency administrator, immediately after the filing for insolvency.
As member of the creditors’ committee, we represent the creditors’ interests, advise and support the insolvency administrator, e.g. regarding business continuation or the launch of an M&A process.
Suppliers aiming at supporting their clients and thus accepting deferments might be confronted with contestation claims raised by the insolvency administrator, years later, if payment irregularities occur. We advise and defend companies confronted with contestation claims from the insolvency administrator.
